Documents required for property purchase in Spain:

  • International passport
  • Alien number

For an alien number you must have:

        • A valid visa
        • A certificate proving the origin of the money (on a letterhead with a stamp)
        • A letter from a Spanish bank stating your account balance (is there enough funds to make a purchase)
        • An agreement proving your down payment for a specific property and copies of the property documentation

The Real Estate Purchase Process in Spain

In order to purchase property in Spain you must open a bank account. If you are planning on taking a mortgage an account should certainly be opened at the same bank that will provide a mortgage. For residents of Spain a mortgage can be 100% financed, for non residents a loan can only be provided for 70% (in some cases for 80%) of the cost of the property.
In order for the bank to review your mortgage application you will have to provide a few documents. The most important of them is a letter from your employer (form 2НДФЛ) which will prove your monthly income. If at the time of acquisition you had an open account at any of the banks, you would have to provide a statement of cash flows on that account. Based on documentation which proves your property purchase in Spain you will be granted an Alien Tax ID number by The Civil Police of Spain. A legal document confirming acquisition of real estate in Spain can be a Contract Senal (Contrato del Senal). This contract usually specifies the details of the buyer, characteristics of the property being bought in Spain, validity period of a contract (can vary from one to three months), and amounts of down payment and deposit made.

Once a down payment will be made the property will be withdrawn from sale and submitted for registration of ownership. Before you sign a Sale Agreement, which has to be notarized, all the required data is obtained from a Property Register (Registro de Propiedad). If you are taking a mortgage on this property you will be signing two contracts: a sale agreement and a mortgage contract between the buyer (you) and the bank that provided the loan.

Of course it is worthwhile to mention the taxes as well: you will have to pay a property tax in the amount of 7% for residential property, and 16% for non residential property of the cost of the property specified in the sale agreement (Escritura de Compra – Venta). In general, expenses related to registering property ownership are not higher than 8%, and expenses related to obtaining a mortgage are about 10-11%.
